1. Overview
This Electronic Communications & E-Sign Consent Agreement (“E-Sign Agreement”) forms part of the Master Terms of Service, Privacy Policy, Payment Terms & Billing Policy, Domain Registration Agreement, Hosting Terms of Service, and all other agreements governing products and services provided by RDK REVENUE LLC (“RDK”, “Company”, “we”, “our”, or “us”).
By creating an account, purchasing services, clicking an acceptance button, electronically signing a document, using any RDK service, or otherwise interacting with RDK electronically, you consent to receive electronic communications and to conduct business electronically in accordance with this Agreement.
2. PURPOSE
This Agreement governs:
Electronic signatures
Electronic records
Electronic notices
Electronic agreements
Electronic billing
Electronic disclosures
Electronic communications
and establishes the legal validity of electronic transactions between RDK and its customers.
3. LEGAL VALIDITY OF ELECTRONIC RECORDS
Customer agrees that:
Electronic records shall have the same legal effect as paper records.
Electronic agreements shall have the same legal effect as signed written agreements.
Electronic signatures shall have the same legal effect as handwritten signatures.
This Agreement is intended to comply with applicable laws governing electronic transactions, including:

Electronic Signatures in Global and National Commerce Act (E-SIGN Act)
Uniform Electronic Transactions Act (UETA)
International Jurisdictions
Applicable electronic commerce and electronic signature laws where permitted.
4. CONSENT TO ELECTRONIC COMMUNICATIONS
Customer consents to receive electronically:
Account Notices
Account creation notices
Security alerts
Account changes
Service updates
Billing Notices
Invoices
Receipts
Payment confirmations
Renewal notices
Chargeback notifications
Legal Notices
Contract amendments
Policy updates
Regulatory disclosures
Privacy notices
Operational Notices
Maintenance notices
Service interruptions
Security advisories
Incident notifications
5. METHODS OF COMMUNICATION
RDK may communicate through:
Messages sent to the registered email address.
Customer Portals
Messages posted within customer dashboards.
Website Notices
Announcements published on RDK websites.
Support Platforms
Messages delivered through support systems.
SMS (Where Applicable)
Text messages where customers have provided consent.
6. ELECTRONIC SIGNATURES
The following actions may constitute an electronic signature:
Account Registration
Creating an account.
Checkbox Acceptance
Selecting “I Agree” or similar acceptance mechanisms.
Button Clicks
Clicking acceptance, purchase, order, or authorization buttons.
Electronic Authentication
Authenticated actions performed within customer accounts.
Digital Signature Platforms
Execution of agreements through approved electronic signature services.
Such actions constitute legally binding acceptance.
7. CUSTOMER REPRESENTATIONS
Customer represents and warrants that:
Customer has authority to enter into agreements electronically.
Customer can access electronic records.
Customer maintains a valid email address.
Customer will keep contact information current.
8. HARDWARE AND SOFTWARE REQUIREMENTS
To access electronic communications, Customer should maintain:
Hardware
Computer, tablet, or mobile device
Internet Access
Reliable Internet connectivity
Software
Current web browser
PDF viewing capability
Email access
RDK is not responsible for Customer’s inability to access communications due to inadequate technology.
9. RESPONSIBILITY FOR CONTACT INFORMATION
Customer is responsible for:
Maintaining valid email addresses
Updating contact information
Monitoring communication channels
Reviewing account notices
Failure to receive communications due to outdated information does not invalidate notices.
10. DELIVERY OF NOTICES
Electronic communications shall be deemed delivered when:
Sent to the email address on file.
Customer Portal
Posted within the customer account.
Website Publication
Published on applicable RDK websites where permitted.
Actual receipt is not required for effectiveness where permitted by law.
11. CONSENT TO ELECTRONIC BILLING
Customer agrees that:
Invoices may be issued electronically.
Receipts may be issued electronically.
Billing notices may be delivered electronically.
Payment confirmations may be delivered electronically.
Paper invoices are not guaranteed.
12. POLICY CHANGES
RDK may modify:
Terms of Service
Privacy Policies
Service Agreements
Operational Policies
through electronic notice.
Continued use of services after notice constitutes acceptance of changes.
13. RECORD RETENTION
Customers should retain copies of:
Agreements
Invoices
Receipts
Notices
Service records
RDK may retain records in accordance with the Data Retention Policy.
14. WITHDRAWAL OF CONSENT
Customers may request withdrawal of electronic communication consent by contacting:

Limit service availability
Prevent account creation
Prevent continued service delivery
Require account termination
where electronic communications are necessary for service provision.
15. EFFECT OF WITHDRAWAL
If consent is withdrawn:
RDK may determine that certain services cannot reasonably be provided.
RDK reserves the right to:
Restrict services
Suspend services
Terminate services
where electronic communications are operationally required.
16. THIRD-PARTY SIGNATURE PROVIDERS
RDK may utilize third-party providers for electronic signatures.
Examples may include:
DocuSign
Adobe Sign
Other approved providers
Customer agrees to applicable platform requirements.
RDK is not responsible for third-party service interruptions.
17. SECURITY OF COMMUNICATIONS
While RDK implements commercially reasonable safeguards:
Electronic communications may involve risks including:
Unauthorized access
Interception
Delivery failures
Technical errors
Customers remain responsible for securing their devices and accounts.
18. INTERNATIONAL CUSTOMERS
Customers located outside the United States acknowledge that:
Electronic records and signatures may be processed and stored in multiple jurisdictions.
Use of RDK services constitutes consent to such processing where permitted by law.
19. NO WAIVER
Failure to deliver a communication through one method does not require delivery through all methods.
RDK may use alternative communication methods when necessary.
20. LIMITATION OF LIABILITY
RDK shall not be liable for:
Email delivery failures
Spam filtering
Technical communication failures
Customer failure to review notices
Outdated contact information
Liability remains subject to the Master Terms of Service.
For the avoidance of doubt, RDK’s aggregate liability relating to electronic communications shall not exceed the greater of:
USD $100; or
Fees paid by Customer during the three (3) months immediately preceding the event giving rise to the claim.
21. GOVERNING LAW
This Agreement shall be governed by the laws of the State of New Mexico, United States.
Any dispute shall be resolved through binding arbitration in Albuquerque, New Mexico pursuant to the Master Terms of Service.
22. SEVERABILITY
If any provision of this Agreement is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
23. ENTIRE AGREEMENT
This Agreement supplements and forms part of the Master Terms of Service and all applicable service agreements.
In the event of conflict, mandatory legal requirements shall prevail.
24. MODIFICATIONS
RDK may update this Agreement periodically.
Updated versions become effective upon publication.
Continued use of services constitutes acceptance of revised versions.

BY CREATING AN ACCOUNT, PURCHASING SERVICES, CLICKING AN ACCEPTANCE BUTTON, ELECTRONICALLY SIGNING A DOCUMENT, OR OTHERWISE USING RDK SERVICES, CUSTOMER CONSENTS TO RECEIVE ELECTRONIC COMMUNICATIONS, ACCEPTS THE LEGAL VALIDITY OF ELECTRONIC RECORDS AND ELECTRONIC SIGNATURES, AND AGREES TO CONDUCT TRANSACTIONS WITH RDK ELECTRONICALLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
